DOT REWARDS TERMS & CONDITIONS

These terms and conditions (the “T&C”) govern the DOT Loyalty Program for frequent guests of hotels of the DOT Hotels (hereinafter called “DOT Hotels Rewards Program” or the “Program”), operated by DOT., with domicile in 2875 NE 191st St Suite 500, Aventura, Florida, USA.

By becoming a member of the Program, you agree that you have read, understood and agreed to the (a) T&C, (b) the terms of use of the Website www.dot-hotels.com and (c) the Privacy Policy of the Website.

These T&C may be replaced or amended from time to time by DOT either in whole or in part without being necessary to obtain prior express consent. This is because you can at any time stop being a member of the Program and consequently your continuity in the participation of it is understood as acceptance of any amendments of the T&C. It is your responsibility as a member of the DOT Hotel Rewards Program to keep well informed of the T&C and any modification to them, so we suggest your regular consultation. DOT will be able to eliminate the DOT Hotel Rewards Program without any prior notice to the members of the Program and without granting them the right to compensation for benefits not enjoyed.

1. Description of the DOT Hotel Rewards Program. Participating hotels.

1.1. The Program is a program of awards for frequent guests of hotels of DOT Hotels, and any further hotels that have been incorporated to it as established in section 3 herein (hereinafter the “Benefits”).

1.2. The hotels of DOT Hotels (hereinafter the “Participating Hotels”) that participate in the Program are listed in the Marketplace or website.

The Benefits granted can only be used in the Participating Hotels.


Both the additions of other hotels to the Program and the elimination of hotels in the list of Participating Hotels will be communicated as established in these T&C and can only enjoy the Benefits (i) in those accommodations that are Participating Hotels at the time of the use of the Benefit; (ii) from its incorporation as a member of the Program. Therefore, you will not be able to claim any benefit for nights contracted before it, nor enjoy Benefits in hotels eliminated from the list of Participating Hotels after such elimination, even if the reservation at the hotel that used to be a Participant Hotel would have been done before its elimination.

2. DOT Hotels Rewards Program membership. Requirements and registration procedure.

2.1. You are required to enroll as a member of the program:

(a) Be an individual, resident in a country that legally permits participation in this Program. No legal person will be able to register in the Program.

(b) Be over 18 years old.

(c) Be legally able to accept this T&C.

(d) Complete the application for enrollment in the Program through the Website / Call Center / Central Reservation Office or at any hotel participant of DOT Hotels.

(e) Provide all the data required by the registration form and have a valid email address, where all the notifications required by the Program will be made. The inaccuracy or misrepresentation of the data provided, or the absence of any of them, will invalidate the application for registration. Any communication sent to a member of the Program will be considered as received two business days after being sent to the email address duly provided. It will be the obligation of each DOT Hotels Rewards member to keep its personal data up to date and to constantly review the email address provided.

(f) Not having previously been removed as a member of the Program for any of the reasons provided for in these terms.


2.2. Registration as a member of the Program is free of charge. No purchase obligation.

2.3. Member status:
Silver status: all members registered in the Program will get the silver status.

Gold status: once the silver status member acquired more than five (5) stays in a one-year period, it will be upgraded to the gold status. Gold status will be maintained as long as the Program member acquires at least five (5) stays per year.


The status of the Program member shall be retained until the member is removed from the Program for any of the reasons provided for in these T&C. No member of the Program will be removed for not having acquired nights in any period. The registration in the Program and the maintenance of the status of member does not require the purchase of nights in the Participating Hotels.

2.4. Bookings where DOT Points are used for payment must be made by the member. The Benefits are non-transferable, either by living acts or by cause of death, unless expressly stated otherwise in these T&C. No DOT Points may be transferred to other members/persons.

2.5. Registration as a member of the Program will be effective automatically. The identification as a member of the Program will be through the registered email. Benefits are registered from the date the membership is created. Post-registration of stays made before membership is not possible.

2.6. In the event that, after the registration, DOT confirms with respect to the Program member the failure to comply with any of the requirements to be considered as such, it will be removed, informing such circumstance and the reasons therefor.

2.7. Any changes in the information provided by a member at the time of enrollment in the Program must be duly modified in the user account profile of the Program member. DOT shall not be liable for any modification to the data that has not been duly informed.

2.8. DOT reserves the right to remove a member of the Program without previous notice and immediately, which will automatically generate the loss of all accumulated Benefits and their status in any of the categories. DOT may exercise this right in the event that the Program member: (i) shows inappropriate behavior, or commits acts that may be penalized, or that are immoral, unethical or discriminatory in any of the Participating Hotels or in any other hotel operated and/or managed by DOT.; (ii) carry out acts contrary to applicable law, (iii) omit the payment of any invoice, by any concept, to DOT, to any of the Participating Hotels or to any other hotel operated and/or managed by DOT, (iv) breaches the terms of use of the Website and/or the privacy policy of the Website, and/or the T&C;(v) uses or obtains the Program-related Benefits in the wrong way; or (vi) any other circumstance not specified above.

2.9. Also, any member of the Program will be able to request the cancellation of their membership by sending an e-mail to reservations@dot-hotels.com, with the subject CANCELLATION OF DOT HOTEL REWARDS MEMBERSHIP. Once this email is received and processed, all Benefits will automatically be canceled.

2.10 DOT Points, as provided herein, will be awarded for stays booked and paid by the Member, up to 10 rooms per booking. Bookings of +10 rooms will be considered as "Group Booking" and no DOT Points will be awarded.

2.11 DOT Points can only be awarded to one member per room.

2.12 To redeem the DOT Points for a booking made on website (Market Place or Vanity Website) or Call Center, log on to your account. You can pay for a booking in part or in full using DOT Points, you can redeem all your DOT Points or just some of them in a booking.

2.13 You can use DOT Points for partial or full payment of bills also during a hotel stay. This is only possible for bookings made through valid booking channels (as provided in section 3.1 herein). This means you cannot pay for purchases at hotels using DOT Points if the booking for the stay has been made through third-party channels (such as Booking, Expedia or Despegar)

2.14 With cancellations made via the website of bookings paid with DOT Points, the DOT Points used for the booking will be returned to the member account if the cancellation policy of the booking allows that. Cancellations must be made via the Guest Portal at www.dot-hotels.com or DOT Hotels Central Reservation Office.

2.15 Any changes to bookings where either full or partial payment has been made with DOT Points must be made via the chosen hotel or member support. Such changes cannot be made via the website.

3. Benefits. Use of them.

3.1. The Benefits of the Program are the followings:

a) Exclusive offers and promotions. The members of the Program will receive offers and promotions to the mail indicated at the time of their registration. Only the Program member will be able to make effective use of these promotions. Offers, discounts and promotions will not be accumulative or combinable. Promotions or offers may consist of special discounts or other types of benefits.


b) DOT Points Program. The members of the Program may earn DOT Points that will be redeemable for the Benefits described here. The DOT Points program is subject to the following special conditions, in addition to the other conditions of the Program:

1. Welcome DOT Points: once the member is duly registered, 5 (five) DOT Points will be granted. 

2. Only the nights paid at a qualified rate and which were booked through the marketplace, the Vanity Website of the Participant Hotel, the Call Center or any hotel´s front desk (hereinafter “Qualified Stays”) will generate DOT Points. DOT Points are not awarded for stays booked through third-party websites (such as, among others, Booking, Expedia and Despegar) or for reward nights, bonus nights, bookings made by tour operators or stays based on sponsorship rates or other special agreements like “Group Booking”.

3. The members of the Program should have previously chosen to get DOT Points in their Program profile. 

4. Program members must provide their membership number to generate DOT Points. 

5. If a hotel ceases to be a Participating Hotel after a member of the Program makes a reservation, the stay will not qualify to accumulate DOT Points. 

6. For every 1 (one) US dollar billed by the Participating Hotel and paid by the Program member (excluding for this purpose the amount invoiced and paid of taxes, charges, fees, contributions and commissions) the member will get the equivalent of 5% of DOT Points. As an example, if a member purchases a night for 100 USD, such member will earn 5% as DOT Points that will equal 5 USD. Those 5 USD Night Discount (as defined below) may be discounted from the next night to be acquired by the member. No DOT Points will be awarded for purchases paid with DOT Points. With partial payment, DOT Points are awarded on the basis of the part of the purchase not paid for with DOT Points. 

7. DOT Points are redeemable for nights discounts (hereinafter “Night Discount”) and have a duration of 2 (two) years since its issuance. Once the deadline is over, they will automatically be missed. Night Discount are understood to be the Benefits for which the DOT Points obtained by a member of the Program can be redeemed. 

8. The DOT Points shall be deducted from the Program member's account at the time the request for redemption is made.

9. All redemptions are final and the Night Discount may not be returned by credit except as otherwise stipulated in these T&C. 

10. Only the members of the Program can redeem the DOT Points in their accounts. Night Discount are not transferable, or redeemable for cash. When redeeming DOT Points, the oldest DOT Points are always used first

3.2. The members of the Program will not be able to enjoy the Benefits with respect to nights of courtesy stay, granted without charge for any reason.

3.3. The Benefits may only be required if the Program member has been identified as such at the time of booking. The grant of the Benefits may not be requested at any moment if at the moment of the reservation the member was not registered in the Program. The Benefits may be used, including special promotions, by only 1 (one) member of the Program per room, whose identity will be informed in the two instances mentioned above.


3.4. Qualifying Stay will be considered even if the Program member does not present itself, provided that the requirements set out in section 3.1 (b) and the Participating Hotel has complied with charging that night's stay.

3.5. The launching of promotions or special offers will be for a limited time, as indicated in the communication of each promotion or offer and may refer to all or some of the Participating Hotels.

3.6. The Benefits will not be redeemable for any other good or benefit, or for additional discounts, credit or cash. If there is no availability for a particular Benefit subject to it, such as priority check in, it will not be replaceable for any other benefit.

4. Use of personal data

4.1. The Program and the data provided by Program members are applicable to the terms of the Website's Privacy policy. Notwithstanding this, it should be noted that DOT respects the right of the members of the Program to the protection of their personal data, which are protected by the law. The database is of DOT responsibility and is duly registered in accordance with applicable law. The participant who wishes to delete or to know the data of his person that appears in it, to update them or to rectify errors, must request it by mail to the domicile of DOT indicated in the heading of these T&C, or by e-mail to reservations@dot-hotels.com. In that case, you will be discharged from the Program.

4.2. Data of the Program members may be used for the purposes of the development of the Program in accordance with the provisions of these T&C and will be deleted from the database once the Program member is eliminated, or the Program is deleted.

4.3. Any changes to the database will be effective within 96 hours of receipt of the request.

4.4. DOT may submit promotions, offers and other communications to the members of the Program on a regular basis, which may include offers and promotions for third party items. Program members who do not want to receive such communications can request it to reservations@dot-hotels.com.

4.5. The data of the members of the Program will not be disclosed to third parties, except to the administrators, operators or owners of the Participating Hotels, to the extent that this is necessary for the operation of the Program.

5. Termination of the DOT Hotels Rewards Program.

5.1. DOT reserves the right to cancel the Program in whole or in part without prior notice and to modify the Benefits, notifying such circumstances to the members of the Program.

5.2. In case of modification of the Program, all the Benefits will expire in automatic form, without any obligation or responsibility in head of DOT nor of the Participating Hotels, and without that implying any right for the members of the Program to claim any compensation or reimbursement.


6. Jurisdiction and governing law.

This T&C shall be governed by, construed and enforced in all respects, including validity, interpretation and effect, in accordance with the laws of the State of Florida, USA, without regard to the conflict of laws principles thereof. Each party irrevocably agrees that the courts of the state of Florida, USA shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this T&C or its subject matter or formation. If any term, provision, covenant or condition of the T&C is held invalid or unenforceable for any reason, the remaining provisions shall continue in full force and effect as if the T&C had been executed with the invalid portion eliminated so long as the T&C continues to express, without material change, the original intentions of the parties.
